Conservatory erected in 2002

My mother had a conservatory erected in 2002. She is now selling her house and the Buyer has requested evidence that planning perission was not required.
I have enquired of the LPA and the planner has asked for the measurements of the detached garage.
The planner has said the pre-2008 regulations will apply. Does this mean that she will need planning permission?

If you can find bona fide proof that it was built 4 years ago or longer then you or the new owners will be exempt from any enforcement action the planners may otherwise wish to take. http://www.planning-applications.co.uk/enforcement1b.htm "So the erection of a building which goes undetected for 4 years will be allowed to remain."

Conservatory and detached garage were considered to be within 70 cubic metres of permitted development so no planning permission required.
