contractor in admin owing thousands to subbies

My self and many others have sub contracts with Rock asphalt and they have now gone into admin.

Does anyone know if i can claim the money i am owed from the main contractors on the jobs we were working on. Or do i have to apply as a creditor to the administrators and get sweet fa.

Hi, sorry to hear of your trouble. We have known for some time that Rock were struggling, we were looking at buying them last year but they were to far gone.

We hear administrators are looking to re finance but their client base has heard of the trouble they're in and are pulling contracts.

If they do got right under, you will be lucky to see 10p in every pound owed, the taxman always gets his slice first :evil:

Apollo are on the verge also we hear, as well as Southern Counties. Its grim out there. Best of luck in getting some money back.
 
It will depend on the terms of your contract.

Normally, you will have no contract with the main contractors or employer - a concept known as privity of contract.

The only way you may have a contractual relationship is maybe if you were working as a nominated or named sub-contractor or similar contract.

But check your contract terms and speak with a specialist advisor to make sure
 
Woody, Rock subs packages out, usually to sole trader type gangs.

The contracts that Rock actually do are JCT . They are/were one of our competitors, we've been watching them 'buy' work for some time to keep cashflow going through, but its caught up with them. Its a shame, they were a long established reputable company, but its dog eat dog out there at the minute.
