Do downlights need to be fire rated for new build?

Hi guys

As it says, is it a requirement or a recommendation for downlights to have min fire rating in new build?

Could be either, depends on where and how they will be installed.

thanks, they are in the kitchen and a couple in the ensuite. In both cases they are flat to the ceiling and not recessed which if i understand correctly decides if they need to be fire rated or not
 
It depends if the ceiling needs to be fire rated, and that depends on what is above/below - e.g. another dwelling or a garage. BCO should advise if in doubt.

Mind you, its hard to find a downlight that is not fire-rated these days. From what you have said though, these are surface luminaires and not recessed into the ceiling, correct?

yes thats right, which if im correct means fire ratings not necessary. As you say though, maybe the ones ive seen do already hve am in fire rating but it doesnt say so on the description

in the kitchen the bedrooms are above and in the ensuite the loft is above
 
Surface fittings do not usually contain intumescent materials, so they will not be described as fire-rated because they aren't and don't need to be!
The only hole made will usually be the cable hole. That usually does not need to be fire-stopped, even if the ceiling were a fire-rated one, which it doesn't sound like it is (does that make grammatical sense?)
