Hello,

My neighbour has attached his gate on my fence post.

Is the anything that can be put around the post like metal plates to protect against these types of incidents ?

If so what can be used and where can I get them from ?

Any ideas ?

Regards,

Jay

If it’s your fence post, he’s not entitled to fit anything to it or paint it without your permission; to do so is criminal damage.

you might decide to take it down every summer to clean and paint it.

the weight of the gate will probably make it lean.

Yes police wont do anything as its a civil matter.

I have no legal cover on my insurance.

It will cost me 100 access if I claim for damage with my insurance company, even though I have vandalism cover they cannot help me as its a civil matter and has legal implications.

Solicitor fees start from £200 per hour.

I am planning on removing gate my self. He attached it while I was at work without permission.

What else can I do ?

I thought remove it and put something on the post so he cant attach it again.

The police will be reluctant to get involved in a neighbour dispute but it is criminal damage i.e. a crime.

If you remove the gate you risk committing the same act of criminal damage to his gate.

You or a solicitor can write to him giving him 14 days to remove the gate and make good any damage, after which you will pursue him in court for the costs of doing so.

Have you actually asked your neighbour to remove it?

what is the post made of, what size, what is is set in? Have you got a gate on your side?

Out of interest, what would you have said to your neighbour had they asked you for permission? Are you making a point, or is there a structural or practical reason why you don't want it there?

Don't get me wrong, i'm on your side, but just wondered?
