He is applying for citizenship, he is not a visa overstayer

He has worked in the USA for over 10 years, lives a fully law abiding life…..supporting the American economy doing a blue collar job.
Failing to comply with a deadline on one item of paperwork doesn’t make him a person of bad intent.

Not once have you provided any evidence that supports him being detained, handcuffed, shackled, thrown in jail.

Just recently when in Gothenburg I had to write an email to myself inviting me to a meeting to get through immigration/customs.

Home Office policy to accept that a claimant’s Article 3 (medical) rights would be breached where there are substantial grounds for believing that they would face a real risk of being exposed to a serious, rapid and irreversible decline in their state of health resulting in intense suffering or a significant (substantial) reduction in life expectancy as a result of the absence of appropriate medical treatment or lack of access to such treatment in the country of return.
So thats settled then:

True. Just 'illegal'.
The reality is he has a legal route to remain. So it is strange that he hasn't been treated differently. But based on my own experiences, there are plenty of "liberal" EU countries who do the same. minor breach = deportation, no ifs no buts.

Simply having to renew your passport (getting a different Passport no.) will mean your visa is no longer valid and it can take months to get it updated. If you travel while its pending - you will be in breach.
