I don’t agree with the view that any assault can kill, most assaults are pushing, shoving, etc.

And people have died after being shoved, stumbling and banging their head. That is why saying somebody could have been killed isn't useful.

Threatening words or raised fists (common assault) doesn't normally result in death.

No rational person can expect to punch someone in the head hard enough to knock them to the ground and then keep going without expected to cause some damage to the brain.

I understood you to be referring to common assault, when you said all assault. If by all assault you mean something along the line of physical violence then, we are in agreement.

On your second point - it's the intent that matters (mostly).

Did you misunderstand that common assault was only physical violence? It is also the threat. People don't normally suffer head injuries from the threat of violence (common assault).

I think that's a different issue. You are presumably talking about the mens rea.

Whether somebody might have died is irrelevant. Obviously, unless you are talking about homicides and their attempts.

The point that was made (mostly by the original judge) is that lesser beatings than that dished out by Punchy Mike, have on other occasions resulted in death and for that reason he regarded it as quite serious.
