its not part of the inspection you would still get your bit of paper it would just say the aplinace is not safe to use and you would have had a warning label/paper work with it .
same as if you took your car for mot and it had 2 bald tires ,you would still get a bit of paper saying failed and a sheet telling you why.

nothing to stop you renting out a property with a unsafe boiler in it ,just it provides a big fat stick to beat you with when something goes wrong and you have written documentation saying it was unsafe.

to the OP
you have had adequate explanation of what your service guy has done wrong, but back to the origial problem, you say the foam was damaged by a leak, repaired by your boiler cover, then get back onto them to get them to replace the foam under your contract, if they play hard ball ask them why an unsafe appliance was left by them after the repair, and can they give you the name of their MD, the address of their registered office and the GSR number, then just as you put the phone down you will hear their guy chapping your door
