The Dublin agreement was not enforceable. It was an agreement that still required the cooperqtion of the participating countries.
It also had some shortcomings. It only applied to asylum seekrs that had already registered in another EU country.

No they only have rights to enter French territorial water under rights of innocent passage, contravening French immigration laws is not innocent passage.
