I have some good news at last. The council inspector did pass it by his legal department and they decided not to take it any further as the change of use cannot be subject to enforcement now. Bizarrely he was quoting section 10 and was still saying that the 4 year rule didn't apply ..I am puzzled but happy nonetheless. Thanks all for your invaluable help.
