I understand that the 12-year basic sentence was based on the norms for 16 and 17 year old murderers, at the time the murder was committed.

What would you consider an appropiate sentence for a 17 year old murderer, Joe?

With respect John, my own opinion is that it would depend entirely on the situation and motive ie if a 17 year old murdered their father and/or a relative that has abused them physically, sexually etc over a period of time then I'd be inclined to want the 17 year old released without charge even if they did premeditate the murder.
 
well, I suppose that's why there is a "basic" sentence, with adjustments according to the circumstances of the case.

however the circumstances you describe don't apply in this case, do they?
 
I don't see that it was premeditated. They never set out to kill Lawrence. It was mob mentality thing. I reckon it's way too late to punish them now as they are no longer kids. I reckon they will get off on appeal. If I had committed murder as a teen, I really don't see that locking me up today would be justice. I'm not the person today that I was then - so why punish me now? The old me has long gone. Isn't it supposed to be about rehabilitation?

Indeed not but I think you're wasting your time if you're hoping for a reply from the freckled bespectacled one.

No, it's about punishment. Rehabilitation is something they hope to achieve. If the law is all about 'rehabilitation' then all fixed 'penalty' fines need to be abolished.
 
A fixed penalty notice is a slap on the wrist. You cannot punish a person that no longer exists. They had their chance to lock them up 20 years ago.

Sorry, but it's not fishing. That's how I see it. Are you the same person you were as 17 year old? Why am I not allowed an opinion just because it differs from yours?
