Hi Folks
Neighbour popped round to tell me gulley was leaking and causing him a problem in bedroom with dripping ceiling. He says partly my respnsibility so asking me to foot half the bill. Terraced property with mine higher up than his. I dont have any leaks. Surely the gulley is there to protect his property not mine. Any comments or ideas about who is resonsible for what?
Thanks

By gully do you mean the gutter or a lead valley or something else ?

If it is shared and not causing you any problems I don't think he can force you to make a contribution. Bear in mind though if the same thing happens in future and causes you a problem they don't have to pay either.
Sad thing is if you pay up now who's to say they will do the neighborly thing and cough up when you have a problem, if they are even still living there?
Moral dilemma!

.

Disagree................if its shared then equal liability.

I mean the lead valley i suppose. Not a builder or roofer so terminology may be inaccurate. Thanks for comments though it seems that it is certainly a grey area. Better hope his insurance covers it.

Won't be covered by insurance if it is wear and tear. If however it was damaged in a storm you may be able to claim, though maybe not depending on the age of the lead.

if it is a valley that is actually on the party wall and the problem is with the valley and not his roof covering then yes it should be shared however if the problem is with his roof covering and he has to do work on the valley to fix his roof then it is his responsibility.
any chance of a picture of the offending item.
