There's a warrant out for their arrest. They're avoiding entering (including the airspace) of countries that will enforce that arrest warrant.
They refuse to present themselves for trial. And Trump allows them to travel to and into USA without enforcing the arrest warrant.
So currently they're fugitives.

A UN Arrest Warrant is a summons to appear. 125 countries are legally bound to enforce the arrest warrant if the suspect enters their territory.
The ICC cannot hold trials in absentia. So by refusing to surrender to the ICC, the suspect is evading trial.
