If someone went through a Gatso set to trigger at (for example) 36mph, they would almost certainly be prosecuted.

Why, then do police decide not to prosecute drivers who admit similar excessive speed immediately prior to an accident for which they are held to blame by the police?
 
I suspect it'd be quite difficult to do so, quite possibly the only evidence would the drivers own admission at the scene, and I'm sure it'd be quite easy for his lawyer to argue the case that the driver was shaken up after the accident and details spoken at the time might have been afected by this. - Beyond all reasonable doubt, and that

And unless the accident was caused by excess speed, there would be little point... and if excess speed resulted in an accident then perhaps careless driving would be a better charge!
 
How is excessive speed actually judged today - with no expert witness or camera evidence and ABS resulting in little if no, continuous tyre skid marks??
Extent of damage? Cannot imagine a control for that per vehicle / vehicle per road surface per collision angle per umpteen other variables - not enough real data using real cars under test conditions surely?? I bet it is finger in the air stuff at best.
Difficult to pin down without real evidence.

In this case, the driver (according to the police who attended the scene of the RTA) lost control on a bend, crossed the white line & struck a vehicle going in the opposite direction. The point of impact was the driver's door, with further contact down the offside of this vehicle. Neither vehicle braked prior to the impact.

The impact resulted in the struck vehicle spinning through 180 deg., coming to rest on the same side of the road, but facing the way it had come.

During the collision, the struck vehicle lost the o/s rear wheel, damaged the near side one & sustained panel damage to every panel from the driver's door back. The vehicle which crossed the white line ended up embedded in a garden wall, with damage sufficient to prevent the driver's door from opening. Both vehicle's airbags deployed.

The police commented that it was extremely rare that a steering wheel airbag should deploy unless the impact is frontal, thus indicating a high impact speed.
 
It is surprising, the amount of energy involved...

I have witnessed rally cars rolling end over end several times, all from around 50 mph... One would have thought 'twas running much quicker.
