Tiles in new build

Hi guys want to know if the builds can refuse to fix this having trouble with getting them to doit pic below

Wow! That is poor! Difficult one to answer, I assume they offered tiled walls as part of the agreement. Probably doesn’t state anything about the workmanship I don’t suppose?
I don’t think it would be classed as a defect. Any clauses on workmanship in the agreement? I would be embarrassed if I turned out work that badly and I’m not a tiler. Perhaps they weren’t either
 
You'd presume the walls were perfectly flat so god knows how they did that?.

I had to level our kitchen walls as I tiled but that was a 50's build!.
