New roof terrace overlooking garden/kitchen

Afternoon all,

looking for a bit of advice, neighbour is sticking a few cheap fence panels around a rear, single storey, flat roofed out-house. I'm assuming this is for a roof terrace of some sort, this gives him a direct eye-line into our back yard and kitchen... the back-yard was over looked from the house anyway so not a great change there (more intrusive though) but the kitchen wasn't.

Don't know if I even object that much but definitely don't feel that happy about it.

Would this be a planning/change of use issue?
 
Wait until he's got a few friends around, they've had a few drinks and he finds out that the roof wasn't designed to handle that kind of load
 
... ffs. Just got a few photographs from the better half, I'm away right now. They've took the fence panel down for the night but the fence posts and mounts can be seen drilled into the bricks around the flat roof, so this is obviously the plan.

This thing, decking... whatever it is will be pretty much at the same height as the far back bedroom with a direct eye-line to the window. They've been fine for years.. what a pair of F-wits.
 
are they home owners or tennants
if its not there property the landlord will be interested in the damage caused to the roof
 
Really not sure, I'd assume the owners.... he seems to have a decent enough job and the house isn't that expensive.

More annoyed that I have to deal with it when I get home rather than concentrate on enjoying my time off...

he simply is not allowed to use a roof as terrace
even julliet balconies are restricted because off overlooking other properties
so a full roof will never be permitted
 
I think the owner vs tenant question was not are they renting, but is the flat a leasehold? If it's leasehold and they don't own the free hold then the building owner will be interested.
 
As mentioned its not allowed for use by human use but it could be built for a welfare area for dog and cats,what is the access to that flat roof is there a large window ?.

Have seen a few of those abominations used as smoking areas,planting areas and animal welfare areas.

Any more photos ?

Does your neighbour know your away ? Some people use the bank holiday to do dodgy building work as the council is on holiday.
 
The fence is obviously going to be tall enough that there won't be a privacy issue. And I wouldn't exactly say it's blocking your view, so I'd say it's a technical breach rather than a material one. The council would surely take action if you mentioned it, so really it's up to you.
 
My house is a freehold so I can only guess his will be the same.

That photograph is from the upstairs bedroom window, so as it looks like a 5' panel he'll be eyeballing that window, the yard and the kitchen windows (the bathroom windows - obscure glass)... when/if the panel nearest goes on it will make quite a difference to the view from the kitchen below.

Desperately searching for his number/email to let him know I'm not mad keen...

There's a large window on the wall at the back you can't see in the photograph, the only other photograph has them in it, so best not :) They probably know I'm away as the car is in the back yard.
 
If they put up some timber panels that high, I'd be inclined to wait until the first gale in the autumn, just for the fun of it.

But yes, that work would need planning and building regulation approval.

Yes very much so,i could post the photos of a flat i looked at last year where the owner let his pets use the roof terrace as a toilet.

Maybe the photos would not be allowed here ?

Are you saying that there is specific provision within the TCPA 1990, that allows a roof top be used for "cat, dog and giraffe welfare", but not human use, and also can be used as a toilet for pets generally?
