Combining Planning Permission and Permitted Development

Hi all, appreciate any help in advance! I've tried to soak up as much info here already, but I'm still a little confused.

Situation is this (as per attachment):

1. we applied for planning permission for single story extension (blue in diagram)
2. we were advised to then apply for permitted development for the section in green. It is well within the 50% house width limit as so we would get it granted, which it was
3. Our building advisor said we can join the two together, because PP was granted first
4. The council suggested we can't join the two together because it would mean the PD is over 50% of the original width of the house. But I would have thought that only counted if the other side extension was under PD as well?


Not sure if this is a bit of a grey area - would appreciate any advice! Have had my heads in the building regulations, but can't see anything about joining PD to granted PP development.

It's a well known tactic to apply for planning and then carry out a PD development in between. The planning element comes into the equation when the development is finished not when it is started. So you could start both elements together but make sure you complete the PD element first.
 
Thanks John - very helpful. The planning was actually approved before the PD was applied for, which was also then approved. We were just a bit concerned about the PD joining onto the actually granted planning permission. But sounds like safest bet is to finish the PD then join the extension onto it at the end?
 
Bear in mind, you don't 'apply' for PD. PD means it is permitted. You could just crack on and build it.

You mean an application for a certificate of lawfulness for proposed use or development? Just curious- who advised this?
 
Thanks for responses - it was application for proposed development. I think we were advised to apply because then it formalised it in case regulations changed. Advised by a planning advisor.

Think the main issue is that for us to have 'finished' the PD, would then mean an exterior wall needing to be built etc. Even though actually we want to make it interior to join with the planning.

Appreciate these questions are slightly rhetorical! Thanks for the answers. This forum is a life safer
 
When you "applied" for the PD element, did you include a drawing, details, statement or suchlike that mentioned that the extension (previously approved) would be there and the PD would be joining it?

Or is your LDC just for the PD element on its own on the back of the house?
