CF neighbour using my drains (edited)

Hi all, hoping for some help.

So my neighbour has just built a porch that extends out from his house and today they have put the guttering up and they want to run the pipe down the house over the wall and into our shared drain.

No we share the rain water from the main roofs into our gully at the front. But my question is. Can they 1) run their new gutter pipe and put it in our gully so there’s now 2 rain water pipes in our gully and 2) cut into our existing gutter pipe and add their new porch rainwater into the pipework?

Property boundaries are absolute, and can not be crossed or built over without prior agreement of the landowner or when permission is granted in law.

Quite often the shared downpipe is central on the building and a wall or hedge has been created on one side or other that has become the visual boundary over time. Is the gully and downpipe really offset on the building? if not it might actually mark the boundary. It might be pragmatic to allow the branch to access the gully to avoid more in-depth boundary investigations....

Yes, the deeds might give a general right to cross neighbours land for drainage purposes. Why cant they?

But what is the problem in reality? Assuming they do a good job of T-ing into the current shared downpipe and gulley, what does a bit of porch roof run-off matter to you? Is it worth falling out with your neighbour over? Wont you just snooker yourself if you want to build your own porch in the future?

It's the arrogance and entitlement of someone announcing they are going to do something that impacts on your property as if its their right.
