You'd probably be in trouble for using "excessive force" or something like that. Which I suppose is reasonable enough, bearing in mind pepper spray would (I think)be assault with an offensive (illegal)weapon on an alleged burglar who had "merely" broken and entered. Unless you argued that you were in fear for your life in which case you could use reasonable force!!!

PS - I think it's crazy too, but I guess it does protect the innocent/stupid as well!

Can anybody tell me how you do this without blowing fuses ? Sick off the pinstripes the little b ast ards are putting down the side of my car !

pepper spray is classed as a noxious gas and if it is delivered as a spray, then it is classed as a firearm.
