chimney removal question.

Hi,I want to have my external chimney stack removed and roof tiles/timber work extended to cover the gap,due to the chimney leaning and leaking water around the flashing.
Some points.
1,the chimney is not used and never will be.
2,chimney is on detached side of house (not shared with any other property).
3,chimney breast removal in loft just to underneath roof level.

Do i need to inform the local council (not in a listed building or anything special like that).?
Do i need council building control to be involved,my builder says no as he is removing brickwork and the existing what is left of the stack will still be in place and no steel/gallows involved.

Almost certainly not.

Just ensure your ventilation arrangements are OK, as you don't want warm, moist air from the house going up the chimney flue and into your loft space.
