Cue all kinds of weird unintended consequences. Dodgy lodgers renting a room and stealing half the owner's stuff after they claim they were in a relationship.

We lived together for lots of years before we got married. We wrote a DIY will each, problem solved.
People just need educating, it doesn't need government meddling in everyone's lives and causing loads of problems.

Just more money for divorce lawyers as any couple living together for more than 3 years must sign an opt out and they must obtain legal advice. The opt out must include full financial disclosure.
So if this law passes I will have to “divorce” ms motorbiking even though we were never married and both understand cohabitation gives no rights.
The idea that a cohabiting couple can inherit is entirely different.

The frustrating bit is that you have to get your opt out “legally certified”. So that’s two lawyers signing off and charging probably £1k each minimum
Wonder if it will bring to the fore any iffy relationships where either one decides to get out before the 3 years otherwise the other half will be after their pension.
But hold on where are they going to live because of the other loony policy renters rights bill there are not enough properties to rent as the land lords have sold up.

under the current proposals they will have to go through a mini-divorce and sign an opt out agreement. They must also get a lawyer to provide a legal certificate.
There are hardly any areas of law, were taking legal advice is mandatory. seems a bit odd.

there is certainty now. If you own it, you own it. It seems the informed are being punished to protect the uninformed.
The inheritance part, I fully support. two people in a long term committed relationship should be able to leave assets to each other in the same way as a marred couple.
The idea that you can invite your girlfriend/boyfriend to move in, pay no rent etc. and they acquire rights after 3 years is quite odd. Not only that, but to opt out requires a declaration, a certificate from a lawyer that they gave advice and full financial disclosure. It looks like you have to do something like Financial Consent Order, in order to opt out of Financial Consent Orders.
The problem with the framework is it's woolly and that means lawyer fees.

Does this mean that after many times of asking i might as well say 'yes'?
Only the selfish ones.
Actually it could mean that both party's are now needing to rent as the one on their own can not afford the mortgage and thanks to labours disastrous renters rights act there will be fewer properties to rent as landlords sell up

The only winner will be divorce lawyers who will get two massive new revenue streams. Money advising on Opt outs and suing ex-partners for support because their ex wants the rent paid.
I read somewhere that they aren't applying the cohabitation rules to inheritance tax, so this seems to be a complete waste of time.

They may as well just make marriage an automatic process after 3 years of living together.
That is effectively what this is. It's an utterly ridiculous invasion of everyone's privacy.
What documents would be accepted as proof of co-habitation? If someone allows a sofa-surfing friend or lodger to use their address for correspondence then do they become effectively married?
Gender will be no boundary either - if you rent a room in your friend's house then you become a couple after 3 years.
Hopefully this nonsense will fall apart under House of Lords scrutiny and will become Starmer's 99th u-turn or whatever his total is now.
