But, if the hole is clay it wouldn't seep to the foundations? Just overspill eventually and filter away.

The plan is to have an access lid and every so often check the depth of the water. If high, then get a drainer in to drain it.

There is no other place for this 'soakaway' as the garden slopes towards the house.
 
Water still seeps through clay soil. Also if it's shrinkable/expansive clay the extra water can make it heave and damage the footing.

My compromise... Token gesture really..... Back fill most of it and only have it 50cm deep. It's really for stopping a small section of grass becoming swampy. Not for rainwater gutter drainage. This keeps it above the level of the foundations. I dug 2m down and still black clay!! Sheesh!
