First you should identify which, if any, regulation(s) address this issue. You will not find any specific to cooking appliances only, they went out long ago.

We did have [476-03-04] in the 16th Edition but that did not make it to the 17th Edition.

You might take a look at [537.1], [537.4.1], [537.4.1.1] and [537.4.1.4].

Now if you can make it fit within that lot you may have a case - and it would be code 2 - but, whilst it might be a good idea to site the switch to the side of the cooker, you will have to work to pin a regulation(s) on it :D.
