Dealing with Non payment DAY 4

Type up a bill and send it to him along with copies of the emails. Make sure the letter is signed for. Tell him that you are unable to contact him by phone and that if you do not receive your money by a certain date, you will be taking legal action against him.
 
I once went to a client's office to repossess some equipment and when I arrived, it wasn't there.

Not just the equipment, or the client, or the office. The building had been knocked down. They hadn't paid their rent and it had been repossessed, and demolished for redevelopment.

They are totally free if you are on benefits. :wink:

No problems with debt. This is only pocket money but I don't like being ripped off and will come out fighting when I have to.
 
Just give the details to a debt recovery company. They know the ropes and will likely get back nearly the same as you pursueing it yourself.

Door step him. iME when people won't take this sort of call they don't have the money. In which case he who shouts loudest and hardest gets paid first.

DAY 5

Phoned twice and answered by his good lady wife who informed that he was out for the day! :lol:

So predictable.

Have named the agency on Linked In and the others are all urging court action without further delay.

I am close to doing the claim online which will cost £90 of which the dishonest gentleman will have to pay. :D
 
The £90 is only the start of it.

You then have to serve a summons to appear. Then you get a date of approx 6 weeks away.
Then- 'IF' you win-(at this stage he will get a CCJ) and he does not pay--you then have to spend more money on getting a 'order to pay'.-which then has to be served on him by hand (by you- or a pal--or by court bailiffs (costs £100 and they are not very successfull on serving summonses).

My advice- would be- take him to court-- and then- if the debt is over £700 --pass it over to 'sherriffs dept--who will elevate it to high court.

He will then get absolutely hammered for ALL charges incurred by taking such action.
It will end up costing him 3 times as much. Providing he has the means to pay it of course.
 
We find that sending a copy of the outstanding invoice, supporting e-mails and a letter advising them that if you don't get payment within 7 days you'll start court proceedings to reclaim the debt usually works quite well. We don't always get the full amount, but in most cases it prompts some action from the other party and if you get 75% of the amount outstanding its easier than actually going through the court. As someone already said, time is money, and going through court will take plenty of your time!

If you do get a part payment but you still aren't happy - make sure you pay in the cheque and wait until it clears before going any further. Cashing the cheque does not indicate you are happy with the payment and the issue is settled, you can still take them to court for the rest!!

If you've got a written agreement (e-mail will do) and you've kept your side of the agreement completely - you should win at court, and you should get awarded costs and interest on the debt too!!
 
I have decided to let the legal system deal with this as the turd is not responding to anything even ignoring calls to his home at night.

Obviously very slippery and is used to evading creditors.

Update

After having made contact with the agent and many hollow promises of payment and producing a final statement of account I have sent him an ultimatum.

If a "sizable" amount is not paid into my account by tomorrow (July 1) I shall be submitting a claim through the courts on Tuesday morning July 2nd.

The turd is very slippery and I have heard all the sob storys and promises etc but I won't be dissuaded and he will have letters after his name soon i.e CCJ :D

It won't help his business when people do a credit check on him and find the CCJ :lol: :lol:
