Decking with no planning permission - selling the house

Hi, we're selling our house which has a small back garden, that we decked around 80% of. Our buyers solicitors have asked if we had planning permission, which we didn't (only just realised we needed to). The deck has been down over 4 years now, do I still need to worry as there's been no challenge, should I apply for a certificate of lawfulness now?

As they are solicitors, refer them to TCPA 1990 Section 171B (1) or buy an indemnity policy - cheaper than a CLD.
