You're saying that the footpath adjacent to a dropped kerb is not a footpath then, rather it is a road?

Or could it be that s.72 relates to driving along a designated footpath and not across one?

As a horseman, I used to find the Highways Act of interest, because (unlike the Road Traffic Act) it applies to us when we are not using motor vehicles.

I suspect, though, that the OP is thinking of using a motor car, not a horse, ass, sheep, mule, swine, or cattle or carriage.

New build has a drive but council will not allow dropped kerb.

I wonder if the OP will ever come back and tell us if this was a condition of the Planning Permission.

I suspect it was.
