A developer has recently built a raised platform immediately behind my back fence. Due to the fall of the platform it was shedding rain water and water from an overflowing kitchen drain directly onto my fence panels. I complained to the local council, who informed that the developer would need to submit a retrospective planning application. Following the addition of a fence (to mitigate over-looking) and a drainage gutter (to keep surface water off my fence panels) the scheme was approved. I have now come to replace my fence panels to find to my dismay that some of the steel posts supporting the platform have been surrounded by concrete and earth up to 18/24 inches high, which has been piled up against the lower part of my fence. In addition the drainage gutter has in part been fixed by brackets to my fence posts.
Although the scheme has received planning approval, it doesn't appear from the local council website that Building Control Approval has yet been sought.
Should the council have approved the scheme? As far as I can see , the problem for the council would be that at the time of the retrospective application the scheme was finished and sight of the steel substructure was hidden.
I wonder if someone could direct me to the relevant planning or building control regulations which the developer is in breach of?
