The rules regarding cold bridging were significantly less onerous back then so it’s extremely unlikely there was ever a beach of the regs and even if there was they will just laugh.
How could a surveyor possibly know there is no insulation above? And even then it’s a minor defect, I guarantee there will be no redress there either.
Add some insulation above it and move on with your life. It’s a poor detail tis all.
Removing some tiles and doing it that way is an option.
