fire rated spotlights or not?

If you have spotlights fitted in ceiling and there is a dwelling above e.g flat, spots have to be fire rated.

If you have spots in the kitchen with a bedroom above do they still have to be firerated?

some say yes some say no.

Maybe its something to do with the flat above being someone else's property, and therefore covered by different insurance, some clause that says your wiring should not have an effect on another property?
I'm sure an expert will be along soon...! ;)
 
No they do not have to be fire rated.

The bedroom is not a seperate dwelling, it is another room within the same dwelling.

Think about it. Seperate dwellings have fire barriers between them such as fire rated ceilings and doors, which must be maintained with the use of fire rated downlighters.

Your kitchen and bedroom have a big hole between them (your staircase), so fire rated downlights are not much use, as the fire will just go round them.
