Footings crossing boundary between neighbours

Sorrry I'm not going to do that it's purely hypothetical its more a case of me thinking up scenarios and what ifs based on learning a little more about PWA's

You mentioned earlier on that a PWA allows you to put foundations onto your neighbours land and I was just thinking is that dependant on what's the other side - if it's close to their own foundations or party wall I get the point of a PWA but if there's no structure or foundations, is a PWA still required if my foundations were to cross the boundary ?

The PWA can only be used if the work being done is defined within the Act.

It gives no right to place foundations unless the foundations are part of the building of a new party wall or party fence wall - which must be on the boundary to be a party wall. If the wall is not on the boundary, then its not a party wall and the Act does not apply and so there is no right to place foundations - ie just like your extension wall.
 
But for clarity the act applies to any groundwork/foundations built within 6m of the neighbours foundations, depending on the depth. It's this fact that seems to be overlooked so frequently.

I.e it's not a party wall so the act doesn't apply - is wrong.
