Is this door a fire hazard

We have a home built in 2010 and had a builder round a few days ago to look at our doors. He told us that our frames needed replacing aswell as there was a gap in the fire seal (image attached). That would let oxygen in and it it should be sealed right up to the hinge. Is he correct?

Builder is talking ball cocks. As stated above, you can easily buy and fit new intumescent strips yourself. They just need to be cut more accurately so they butt up to the edges of the hinges and the two side strips butt up to the top strip. The strips do expand as they heat up, and they may swell to fill that gap that Freddie suggests, but I would just buy some new strip and cut it to the correct length.
Another alternative would be to buy a tube of intumescent mastic to fill the gap. Cost less than a tenner and you could fill, (and smooth), any other small gaps. You would need a caulking gun to apply it but lots, lots cheaper than a rogue builder ripping frames out and damaging surrounding plasterwork when there is absolutely no need to. Tell the builder to sling his hook elsewhere.
 
I've tried heating up those intumescent strips and they expand quite a lot.
If you're really concerned, buy the correct width strip and replace it yourself.
Once you lift the first bit with a flat screwdriver it should come off with some pulling.
It helps if you use a hairdryer between the frame and strip, where the double sided tape is, to soften the glue.
