Lean-To REGS?

hi,

i have just moved into a detatched house that has a kitchen extension that goes right up to the boundary line with next door.
next door has a double detatched garage approx 8' away from the side of my house which i think used to be an access way into his back garden.
he has now built a lean-to in this 8' gap attached to my kitchen wall (i think using wooden batons) to keep his garden equipment in.

is that allowed??

because you could now say my house is now a link detatched???
 
If it's your wall, within your boundary & there is no party wall agreement, he's not allowed to fix anything to it or touch it; this even applies to a wooden fence!
 
what would be the best way to deal with this?

get in touch with my planning department??

i want to do this by the book?
 
Its not a planning issue, but a property one.

You would have to formally ask him to remove it, if not then apply to the courts as it is a trespass. Don't forget the costs of making good to the wall

Alternatively, you could licence this to him on payment of a fee
 
The best way to go about it is to try & talk to him first, explain he can’t support his “lean to” off your wall without your permission & that you’re not happy about what he’s done. He should have at least asked your permission but, chances are, he’s not even aware of the legal position. If you get on with him, at least you stand some chance of maintaining the friendship; if you don’t get on with him, he’ll most likely to tell you your fortune anyway! If that fails to have the desired effect, the next step is a solicitor’s letter & if that still doesn’t have the desired effect, court action as Woody says.

Do try & sort it amicably as such disputes can drag on for years & become costly to resolve; also check thoroughly that there is no party wall agreement! It’s worth remembering that he can just as easily put up his own wall or posts etc. on his side of the boundary right next to yours so his new tool shed is probably there to stay anyway.
