lighting circ. without earthing and PIR

Given an old house lighting circ. with no earth, will this pass the PIR all other things being equal?
 
It'll be a code one if class 1 fittings are connected, probably a code 4 if they arn't (possibly a code 2 :? ), of course, providing it passes the IR test...
 
iirc it could be considered a pass *IF* the installation can be considered acceptablly supervised to stop class 1 equipment being connected.

however i don't think you could say that would apply to a domestic installation.
