Location of boiler under counter (moved from Information)

Hi- we currently have an under counter glow-worm combi boiler energy 35c model. There is a rear flue. The clearances above is not the 150mm and it's not quite 60 in front of it. See photo.

We want to put a new boiler in this space and happy for the same boiler but our plumber says he can't do it as it's not regulation.

Can anyone advise? We don't have any other outside walls or other areas it can be in and we dont want to have to remodel our kitchen to accommodate a boiler.

I wonder what regulation. Might not meet the manufacturers recommend clearances for servicing, and indeed looks awkward to work on, but I can't see much wrong.
A picture of the flue termination outside might help.

Why do you want to replace at all?

We have the exact same property next door so not technically not replacing. Just putting in the same and that is the only space we have to work with. Unless we could put it in the attic above the bathroom but it does not have fitted stairs for access and the outside wall has no access as there is a large conservatory below. We are first floor flat. Getting another plumber round on Monday for a quote and will see what he says. Thanks for all the advice so far!
