you neglect to mention whether the downlighters are mains or not so earth is only needed at the terminal block for the mains to the transformer if they're 12v..
but since it's a flat, i'm guessing fire hoods...

Fire rated mains downlighters identical to these ( http://www.tlc-direct.co.uk/Products/GUFRD50SC.html ) apart from the colour.
Earth was connected.
No hoods but presume they don't need them being fire rated (They are in the ceiling of a first floor flat, two storey block, they project into roof space under the insulation).
