Let him take you to the small claims court. I honestly don't think he will, and when you show the judge/magistrate the work, I think the claim will be dismissed. It might be prudent to threaten to take him to court to recover the costs of recifying his shoddy work. Potentially, the costs will be higher than his invoice.
I am not a lawyer... I get the impression that a judge/magistrate will want evidence that you offered him the opportunity to "make good". Based on your last post, he seems to be unwilling to rectify things.
One of my best friends is a pointer. He can look at the existing pointing and work out how much white cement might need to be mixed with the grey cement. Additionally, he is able to source sand with the correct levels of aggregate.
Your guy looked like he used a spoon to apply the mortar. That said, those bricks look like a mare to point- neverther the less, it wasn't a problem for the original brickies.
