It could, but you need ventilation for OF appliances. You wouldn't want 100cm2 of ventilation in a bathroom, or any room really, which is why they don't sell open flued appliances now(as far as I know).

If they put enough air vents in they would probably take the shower out as it would be too cold to use it, then it would comply. The rules are the rules, I don't make them, I just comply (or complied) with them.
