Quite - so, as I suspected, 'making non-compliance worse' is a red herring, if there is no non-compliance in the first place

My word is law. If I asked them to jump off a cliff I would expect them to ask me which cliff they must jump off.

Then you would be acting outside your authority, and you should receive (at least) an official warning, if not struck off.
 
no, you are perfectly entitled to suggest it, and put forward any benefits you envisage. An assessor does not have the role of inventing rules.

I don't have to because I don't need a third-party to assess certify the installation.

However if I told someone to do something in that capacity
