I don't think you really understand that boats sit on top of the water and move with the tide at exactly the same speed as the tide. It's only an issue close to land or objects that are fixed to land. Fortunately, people build harbours, walls and marinas to avoid the issue of strong conditions impacting berthing/landing etc.

Remember we were discussing the time taken to reach a port depending on the wind, tide and sea conditions?

They are a commercial vessel by definition of having more than 12 passengers. They must file and notify. It is an immigration offence not to. Even I have to do it with 4 passengers.

I wonder what article 19g says about a vessel that is in breach of customs and immigration laws?

UK or any other vessel has is required to rescue drowning people at sea, in French waters and France has no power to refuse to allow them to disembark in France.
In your post you quoted SOLAS and SARS regulations in your claim that pushbacks are legal.

If we are paying France millions of pounds to stop illegal crossings, then France should have money deducted for every person that reaches the UK. £10k. The same as a lorry driver would pay per illegal that are found in their truck. I’m sure the French would be a bit hotter on stopping them than they currently are.

Any vessel carrying more than 12 passengers is a commercial vessel and must comply with commercial regulations. All vessels must file before departure and report prior to crossing at the 12 mile limit. Which in dover/caliais is still in French waters.

It will therefore be obvious that a boat looking like this heading for UK waters, that is not transmitting AIS, has not filed paperwork and has not called in at the 12 mile limit. is.... not an engaged in innocent passage.
