Nasty little thug and his gang terrorise an estate, and eventually kill a girl by shoving fireworks through her letterbox and burning the house down with her inside.

so, heres why there a waste of time and need scrapping.
1. Kids with ASBOS dont generally give a ****, wear an ASBO like a badge of Honour. The rate at which ASBOS are ignored is massive. You see regularly stories of kids being dragged back into court for breaching them, and the courts do nothing, just smack there wrists and send them on there way. There unenforced, and unenforceable. In 2006 The Home Office said 47% of ASBOS were breached each year. A National Audit Office study put the figure at 55%. The NAO, which analysed 1,000 cases dating from 1999 to April 2006, said 35% of Asbo holders had breached their order five or more times. FIVE TIMES??? Its a joke!!!!
The little thug in question had EIGHT previous convictions for criminal damage and common assault, and had breached his Asbo several times. WHY was this nasty little prick STILL walking around free????.
The order meant he should have faced jail if he caused trouble anywhere in England and Wales.
2. Theres also a further worry. ASBOS make something that is otherwise legal, like walking down a street, illegal for just one person. This really is an horrendously undemocratic thing. The law MUST apply not only fairly and evenly, but also equally to all. So have a law for me, personally, that doesnt apply to the rest of you, is a form of totalitarianism, and very very undemocratic, and deprives me of my civil liberties.
3. If im doing somethign wrong, that needs to be stopped, then we need a properly written law that applies to all. The only reason we have ASBOS's is because Labour was utterly incompetent and unable to write even the most basic statute with leaving it full of loopholes and exploits.
ASBO's are being used in cases where they were not intended to be used, in highly inappropriate ways - theres cases of ASBOS' to stop ice cream vans, to stop little old ladies from feeding the ducks, and stop old men from walking there dogs, and even to stop a pet shop selling goldfish to people. The whole concept is being abused by the petty bureaucrats (as usual). Labour never learned, or ignored, the fact that if you give legal powers to tin pot council workers, they WILL use those powers inappropriately and with a vengeance ( c.f RIPA)
The case in the link, the little thug should have been prosecuted a long time ago for threatening and abusive behavior. or intimidation, and chucked in a youth offenders institute, to send a clear message to him, then maybe this wouldn't have happened. What it does show is that Labours claim claim to be 'tough on crime, tough on the causes of crime' was, as usual, nothing more than hollow spin with no substance, that they never had any intention of implementing.
