Neighbours flue terminates in to my garden

AFAIAC there is a 600mm minimum clearance required to the boundary, sot he boiler is non compliant, assuming fitted after the relevant date (which I cant recall or be bovvered to check).
Normally the difficult issue is spoiling neighborly relations, but in this case there is no real issue. Try to get the LL to change the boiler. H e may be able to run a flue extension so the terminal is in an appropriate position. You may wish to point out that when he sells the house he has to declare any neighbour disputes

The OP has not advised where the boundary actually is p[laced.

It looks to me as if the houses were built like that.

If so it is most unlikely that any legal words were used to cover the over hanging gutter, downpipe or flue.

Lets assume the boundary is on the wall of the neighbour.

In that case he is not permitted to discharge over your land. Getting an injunction against him may not be so easy. He might claim prescriptive rights!

Most cases like this that I see the extension builder agrees to pay for the flue or boiler to be relocated. That can be £200 to £2000 depending on if the flue can be made vertical or a new or relocated boiler are required.

Looks to me as if it could be a Baxi Solo 3.

OP, what is your boiler model if all the houses were built together?

Prescriptive rights, whatever they are, will not over ride the required 600mm clearance.

What do you mean by the builder paying for the new boiler? Why would he do that without charging it to the job, which the OP will pay for? This is not exactly a multi million £ development where they have to pay section 106(?) fees out of their mega profits.

Do you feel you always have to write SOMETHING ?
 
OP: get building control out to you. They will have a look and advise you FOC.
