civil or criminal court?

Simple question, Builder has not paid all the monies due to the window supplier despite being given a cheque for the full amount.
Should this be treated a theft?
(He's 'done a runner', the chippy hasn't been paid all he's due either)

It would be nothing short of a miracle if you managed to persuade the police to do anything. If you want to see the builder in court it will be a civil one.

If you didn't pay your council tax it wouldn't be long before plod would be knocking on your door to arrest you and drag you up in front of a judge.

Don't think "er the builder never paid me" would impress the wiggies.

something not right here

if the contract is between the window company and the builder then it out off your hands and between the window company and the builder

if the contract is between you and the window company why would you pay the money to the builder ??

Because we're bl**dy fools.
What happened is the window rep came out gave the guote we paid the deposit and gave the balance to the builder to pay on collection.
He then seems to have spent the money so the windows haven't been released, however after some heated exchanges he has promised the window company that they will be paid next week. I gather he's hoping too start another job and use the advance to pay his debt.
He's a true cowboy, he's only halfway though our job left us in a complete mess and £15000 poorer.
Anyone in the Carmarthen area looking for a builder contact me and I'll tell you who not to use
