Seaworthiness is affected (not exclusively) by the load upon it.

So your statement is nonsense.

As much - correct. If not more so, especailly where desperate migrants and greedy smugglers are concerned - yes.

A valid legal document can be rendered pointless if another 20+ souls hop on board and destabilise the craft.

It doesn't matter how much you try to explain this to him, he will insist that he is right and try to deflect the problem onto you, it is something wired into him and he feels it as a personal loss by him being wrong therefore it must be you that is wrong for him to feel better. He is very much like Trump in this respect.

if we allow you to separate the load on the vessel from its seaworthiness criteria, just for the point of debate, do you believe that these vessels could be seaworthy for say 15 people?

Do they have the required CE plate? No
Are their skippers commercially endorsed? No
Do they have the required safety kit onboard? No
Do the French Police use their legal powers to enforce these laws? No
Would they stop you, in a French marina, if you had 6 people in a dingy certified for 3? yes, would you get a fine, probably.
