It's irrelevant to the OP what legislation requires him to rectify the bannister, if there is legislation requiring him to do so
He happens to have looked at building regs, probably because that was the only thing he could think of which may apply. It's not, so he should widen his search for the relevant legislation which a landlord should know about and should comply with.
