cctv and the law..

There does seem to be some confusion on this topic. I can say without reservation that if you have CCTV cams on your house covering your property and they happen to pick things up in neighbouring properties then they can and there is no law to stop you. I have had dealings with this subject. Its just the same as taking photos of your child oplaying sport and happen to have another child in the picture.... no law against it.

Only for private use Robbie ... Try posting the pictures of your children on the internet with someone else's in the background and see what trouble you find yourself in.

You need informed consent from all covered in the photograph to do so or must pixellate out their faces.

This doesn't just apply to children, incidentally, you need consent from adults to publish their picture under certain circumstances.

Watch the developments with facebook and similar over the next few years to see the effect of this.

When I was in the Caribbean last March they were filming a documentary about the island (some famous American presenter was doing it ... I didn't recognise her ... Pretty though  ) and they had dozens of people going around with clipboards obtaining permission from everyone on the beach just in case they appeared as backdrop in any of the shots.

Plenty of people wouldn't sign and they ended up moving to another beach because they couldn't take the risk of someone's face ending up in shot without permission.

The nice young lady I spoke to said that they don't mind pixellating out a few people but there were so many on the beach that the shot would have had no background at all

All to do with an individual's right to privacy and there is absolutely no distinction between commercial or private in this respect.

If in doubt ... Pixellate out is my advice

See where your comin from matey but as i said before alot of people think that if their child is in a pic that you took when you photographed your own child child playing sport or such like they think this is illegal But they cant do nothing about it, I know what you mean about showing it publicly which is a different thing. same as if you cctv shows your neighbours garden they cant stop you.

More and more schools are banning video'ing at sports events and plays etc.

Sad really.

i want the cameras up for my property, but the old couple next door say they want then to cover their property too, but there is a public footpath between our houses..... do i need to stand outside my house with a clipboard 24/7?

You sure it wasn't that they wanted to borrow a video, just so they could remind themselves how it's done? :)
