Chimney Question

I live in a terraced house and my fireplaces are on the right side of my house, both my neighbours fireplaces on the right side of their houses also.

My neighbours chimney which in on the left of my house the right of hers has some mortar missing and has hinted that I should have it repaired.

The chimney is on the party wall but is for her sole use.

My chimney is on my right side of my house and as far as I am concerned it is all mine and any repairs are up to me.

But why would I want to try and squeeze in a fireplace in the hallway or on the landing? I have no access to her chimney at all?
 
So you have no responsibility to repair the neighbour's chimney, simple. The fact that it is attached to the party wall is a red herring.

I agree, it's her chimney, so why should you repair it. If it was her fence, she would be expected to repair it, so politely let her know it's her chimney, and therefore her responsibility.
 
Being honest the wall of the chimney closest is probably technically a party wall and you both own it equally. But in practical terms she's probably just hoping you'll fix it, why wouldn't she just do it herself!
 
Well the part of the chimney within the house would definitely be a party wall, but as it's the part of the chimney that's on top of the roof that needs repointing, and only she can make use of it, I wonder if that falls under the definition of a party wall as well.
 
In Lancashire were there are thousands of terrace streets and chimneys.
When its a chimney that is for the sole use of one property
then the property that uses that chimney is responsible for
the maintenance of that chimney.
