I wonder if the guy who did it can be traced? Or anyone doing an EICR before? I have had problems where some one has split upper and lower floors and used twin and earth between switches borrowing the line from another switch on same plate, but what you show is a single switch, so can hardly be blamed on not realising there were only two live wires in the cable.

I found a 3 core .75mm flex clipped under the bannister from top switch to bottom switch
