Any installation you work on has to comply with BS7671 when you have finished.
Therefore if it is a TT supply fitted with a VO ELCB as an incommer then it doesn't comply. If you work on this installation then you have to put it right.
Its like if you wired a socket on an installation with reversed polarity, you cant leave the new socket with reversed polarity, as this is unsafe, so you have to also sort out the polarity problem.
