I need legal advice re dodgy land lord + boiler

Both I would have thought. How can you rent a property without heating?
 
I don't know the legal stuff but can tryme send the landlord a recorded letter quoting if the boiler is not sorted out after few days, then will get a plumber in and send the bills to the landlord providing the boiler is faulty?

The touble is that it is working (albeit not very well) and is not unsafe since at worse the prv will squirt water. and the landlord has got a GS bloke to confirm this.
 
The landlord seems to be in breach of contract. Therefore he has blown any rights to you giving him notice in accordance with the agreement.

I'd withhold rent and look to move out at your convenience. You may have lost your deposit, but you'll reclaim it via not paying rent.

they do if the property is advertised as coming with what ever form of heating it may be. it also needs to be in a safe working condition.
 
the boiler is still not repaired and is infact worse. not fiering up at all only the odd chance.

so we have no hot water or heating.

spoke the land lord who said that if i call out an engineer its at my own expense.

legally what can i do? i tried to report him to the gas safety register and they didnt want to know.
 
You could try the local council. Tell them the conditions your living in (no heating/hot water) I'm sure they can perhaps force the landlord to do something about it. If not, they will certainly suggest the way to procede.

we cant live like this but at the same time cannot afford a deposit for another place. we are also concerned he will provide a bad reference and hinder our chances.
 
Have you tried Citizens Advice? (I must admit, I haven't read the whole thread).

A member here, 'Bahco' is a Citizens Advice Advisor. Perhaps he point to a source of help.

Section 11 of the Landlord and Tenant Act 1985

Installations for the supply of electricity, water and gas and for space and water heating The landlord is obliged both to put these installations in proper working order, and to keep them in proper working order.

In one case, it was decided that, to be in proper working order, an installation must be capable of carrying out its functions under all conditions it is 'reasonable to anticipate' (endnote 20). The installations covered include water and gas pipes, electrical wiring, water tanks, boilers, radiators, and other space and water heating installations, for example, vents for underfloor heating.

The landlord does not, under section 11, have an obligation to keep in repair other installations which use electricity, water or gas, for example, a washing machine or portable heater. However, the landlord may have other obligations in relation to these.

You should speak to your landlord politely and remind him that this is covered under Section 11 of the above Act. Give him the option that you will get it fixed today and take the charge out of the rent if he is willing. :wink:

Good idea to read the following:

The tenant should make a written description of the disrepair and collect the following evidence:-

proof of when the landlord was notified of the problem, for example, a copy of a letter
photographs
expert evidence, for example, from surveyors or environmental health officers
medical reports, if the disrepair is affecting the health (including stress) of the tenant
details of any costs incurred as a result of the disrepair.


The tenant will need detailed evidence.
