Neighbour proposing to site boiler flue within my boundary

in the short term you wont die from it, so if it costs them time and hassle after the event so be it, hell mend them, no respectable installer would do such an install so you will prob find they are a cowboy, prob difficult to know when it is going in, but if you could be there and talk to the installer telling him you have contacted the variuos parties nd they are VERY interested to know who would do such an install you might spook them into walking, and if not tell them you will sue them for tresspass and damage to your property and also it would be nice to be sitting on your patio while they were working to see if they advise you of the hole coming through, imagine getting hit by some debris and getting injured, but wind them up by taking pics of everything they do, and their van and registration number etc, tell the neighbour she is wrong to instruct such work and will be left with a bill for £100's when it all goes belly up and her cowboy trots off into the sunset and she needs to get someone else in to fit it, and without saying anything at all to her it would be a great pity if her new flue kept getting blocked and shutting her boiler off

The boundary line is the fainter line right by the fence, bolder line is chalked line where neighbour currently proposing to site flue
 
the nearest edge of the flue needs to be at least 150mm horizontally from any hole in the fabric of the building, it doesnt look as if there is a min of 200mm from the chalk line to where the window frame meets the hole in the wall, watch the installers horse doesnt crap all over your patio :LOL:
 
LOL, Roy Rogers & Trigger better not rain on my parade! Had a meeting with Property Manager who was aware the neighbour proposed to site flue next to her window as she called him to question issues re deeds/lease, but like me presumed it would be to left of her window beyond my boundary and not within it.

He totally agrees that she is contravening all sorts of things, inc Land Act re trespass, party wall issues, breaching terms of lease regarding my quiet enjoyment of my property inc my patio and building regs. Planned meeting with him as mediator on Saturday to discuss which I hope will enable neighbour to wake up, smell coffee & see sense!

More crap for her too as it turns out Southern Gas in carrying out works to link gas pipe into her flat have damaged roots of nearby tree which has a Tree Protection Order attached to it. He's getting on to the council to report it and has taken pics... oops!

Is the window to the left of the chalk line openable? If so then it's too close to the flue by the looks of things, so there's another reason not to have the flue there.
 
Print a copy of this thread off and put it through her door. It'll make her think. ;)

It isn't openable, its in the communal hallway, high up above the immersion heater cupboard so probably not an issue.

Re the chalk line, I wasn't able to ascertain from neighbour as to whether she drew it on wall or her contractor and anyway probably not accurate, more likely denoting where her kitchen wall ends and so within which space flu will stick out, either way on my patch not hers...
 
Thanks a lot for all the bits of advice from everyone, feeling far more confident and cross fingers it will all get resolved as amicably as possible on Saturday.
 
Just a point to note.

Several posters have suggested blocking the flue up.

It is illegal to touch the flue, even when/if it is breaking the law.
 
If its solely your patio you dont have to give access to them so block up you gate.

The party wall act is a very powerful legislation! You could probably take out an injunction and claim damages if she starts any work PROVIDING its really your party wall.

One of my customers, a well off banker bought a terrace house in a posh part of Notting Hill Gate. But he/his contractor started non invasive work on his side THREE days before the notice expired.

The neighbour was an unemployed barrister and took him to court which was a hearing expected to take three days and the banker's barrister alone was charging about £7500.

And all because they deemed to charge for regurgitating something that was readily available in a published tome.

Just when I thought good sense would prevail.... Neighbour says she is too busy to commit to meeting up with Property Management Manager and I on Saturday, so looks like now she's turned down mediation option, let her act & be damned. That is if she can find a suitable Stetson wearing contractor who will agree to do it!

Wouldnt dream of tampering with the flue if it does go in, will just rely on the law to do my bidding!

not always joe, but in this case yes i'm with you just call the police and have them removed, if they do anything to your side of the wall then look at criminal damage as well.
