No. The indemnity only covers the legal fees associated that you might amass during legal proceedings. It absolutely does not pay for any remedial costs, no doubt your solicitor has failed to mention that.So pay £90 & should anything happen in the future for the new buyer that then lives here the insurance will pay to fix it correct ?
In anycase it's irrelevant, you're beyond any time limits. Have a google as to how often these indemnity's are ever enacted. It's practically zero and even then only if the bloody thing's within the time limits.
But solicitors are thick (and/or like the little commission they get for every policy they sell). So fight it or suck it up, it's up to you.
